2. Intellectual property

All trademarks, models, products, illustrations, photographs, texts, still or animated images, video sequences, sounds, the site architecture, and all software components used to operate this site, and more generally all elements reproduced or used on the site, are protected under applicable intellectual property laws.

X-Makers owns, or holds the necessary rights to use, all elements accessible on the site.

Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements without the prior written consent of X-Makers is strictly prohibited and constitutes an infringement of intellectual property laws and of these terms.

Users are in particular prohibited from:

• copying, reproducing, representing, distributing or publishing, permanently or temporarily, all or part of the content and/or the site, by any means and on any medium;
• creating derivative works from the content and/or the site;
• modifying, translating, adapting or arranging all or part of the content and/or the site;
• disassembling, decompiling or reverse engineering the site.

The purpose of https://www.xmakers.io is to present the activities of X-Makers and to allow interested companies to apply to its program. X-Makers strives to provide information that is as accurate as possible; it cannot however be held liable for omissions, inaccuracies or failures to update, whether caused by X-Makers or by third-party partners providing such information.

All information on the site is provided for guidance only and may change. It is not exhaustive and is subject to modifications made since it was published.

4. Site management

The site is normally accessible at all times. For proper management purposes, X-Makers may at any time:

• suspend, interrupt or limit access to all or part of the site, with or without notice;
• remove any information that may disrupt its operation;
• suspend the site in order to carry out updates.

X-Makers will endeavor to inform users in advance of maintenance dates and times, without incurring any liability if no prior notice is given.

5. Liability

A. Access to the site

X-Makers endeavors to keep the site accessible 24/7 but makes no commitment as to its permanent availability and does not warrant that the site is error free. X-Makers cannot be held liable for any failure, breakdown, difficulty or interruption preventing access to the site or to any of its features.

Neither X-Makers nor the hosting provider can be held liable for any malfunction of the internet network, telephone lines, or computer and telephony equipment, in particular due to network congestion preventing access to the server.

X-Makers cannot be held liable for legal proceedings brought against a user as a result of the use of the site or of any other service accessible via the internet, or as a result of the user's failure to comply with these terms. Nor can it be held liable for access to the site by minors, or for inaccurate or misleading information provided by users.

B. User equipment

The equipment used to access the site is the sole responsibility of the user, who must take all appropriate measures to protect their equipment and their own data, and access the site using recent, virus-free equipment and an up-to-date browser.

X-Makers is not liable for damage caused to users, third parties and/or their equipment as a result of their connection to or use of the site, nor for indirect damage (such as loss of business or loss of opportunity) resulting from the use of the site.

Users undertake not to disturb other users' use of the site and not to interfere with or interrupt its normal operation.

6. Hyperlinks

Setting up any hyperlink to all or part of the site requires the prior written consent of X-Makers, to be requested by email at admin@xmakers.io.

X-Makers is free to refuse such consent without having to justify its decision. Where granted, the authorization is temporary and may be withdrawn at any time. Any link must be removed upon simple request.

The site may contain hyperlinks to other websites. X-Makers has no control over the content of such websites and accepts no liability in this respect.
